CUSTOMER'S RESPONSABILITES 1. The customer's (corporation or partnership) agreement to all terms of this contract is indicated by his signature or that of a designated representative for the duration mentioned by the contract which will end when the equipment and accessories are returned. 2. The customer may not, at any time, sub- lease, lend or mortgage the equipment and accessories rented/loaned. 3. It is the customer's responsibility, upon receiving the rented/loaned equipment to check its appearance and operation. 4. It is the customer's responsibility to periodically check the quality of the results given out by the equipment and accessories rented/loaned and will not escape or waive his responsibilities upon termination of the rental period of any problems that may have occurred during the rental period. 5. The customer must inform the lessor in writing of any anomaly, defect in the equipment and accessories rented/loaned to allow the lessor to take arrangements with the customer as quickly as possible. 6. The customer relieves the lessor of all responsibility as to any damage, equipment or accessory breakage, data loss or any other problem that could be caused by the use of the rented/loaned equipment . Furthermore, the customer cannot hold the lessor responsible for an amount higher than that of the rental contract. 7. The customer agrees to pay the lessor, an amount equal to the cost of the repairs or replacement of the equipment meaning the new market value if in the lessor's opinion, the equipment and accessories have been damaged. The customer will receive a written copy of the claim. 8. The customer agrees to pay the lessor the new market value of any equipment and accessories that have been lost. The customer agrees to pay the invoice according to the lessor's terms and conditions. 9. The customer agrees to pay the lessor a penalty for any late return of equipment and accessories including robbery and damage; the penalty is calculated according to the current daily rental rate. 10. The customer is expected to use protection screens at all times for lighting sets. The lessor is not liable for any damage caused by a misuse of lighting sets. 11. If the customer violates one of the previous clauses, this would automatically terminate the contract without formal notice or legal proceeding and will give the lessor the right to take back the equipment and accessories. 12. The lessor may take his equipment and accessories back without loosing his right to claim the rental fees and damages sustained by the customer's non-compliance of the previous conditions. 13. In the event of disagreement between both parties concerning a technical problem during the equipment rental, Sono Video Inc. has the right to call upon an external firm to determine the cause of the problem. 14. If the lessor hires a lawyer to defend his rights, the customer will be held responsible to pay 20% of the claim for unpaid fees which will cover extrajudicial fees and other taxable fees. 15. The customer cannot terminate the obligations of the present contract until the lessor has received full payment of all direct and indirect fees related to the present contract. 16. The customer cannot escape any liability described in the current contract. Below the customer's signature will appear the following: THE CUSTOMER DECLARES HAVING READ AND AGREED TO THE CONDITIONS OF THE PRESENT CONTRACT.
